Publications: Structuring A Sustainable Letters Of Marque Regime, By Lieutenant Todd Hutchins

A big hat tip to David Isenberg for finding this paper and writing an excellent article about it. Also bravo to the California Law Review for publishing this paper and hopefully between this site and David’s, we can really promote this thing. I am always on the lookout for modern legal interpretations of, and the possible uses for the LoM.

It is also cool that the author of this paper is an officer in the US Navy and a current JAG student. Maybe he can come up and talk a little about any feedback he has received for this paper, and the reason why he chose this particular topic.

Now for a couple of points of interest. Lt. Hutchins is more focused on an international LoM system, as opposed to countries issuing LoM’s. You know, I don’t think this approach would work, just because personally speaking, I would rather answer to the laws and customs of my own country versus answering to an international court. What is to prohibit any biases towards me and my nationality in such a international court?  So personally, I would much rather have a LoM issued by a country whose legal system I trust and would give me the best odds in a trial of my peers–from my country.

I still think companies would seek an internationally issued LoM. Especially if the profit margin was there. If it is not, then the risk will definitely not equal the reward and this industry will not thrive. You really need to make the enemy into the ‘Blufin Tuna’ or ‘Buffalo’ of prizes.

Which brings me to my next point. Offense Industry requires a strong profit motive for the destruction or capture of a declared enemy. The reward must equal or be greater than the risk in this case. I tend to lean towards greater than the risk, just because we want extreme competition for this highly valuable enemy.

So the question with this is if the enemy has enough assets that can be seized and decided upon in a prize court. The guys with the money are on land or hiding out in Dubai or wherever. How will a company be able to seize their assets on the international stage?

Now privateers like Captain Morgan did do land raids to capture enemies and their assets. He was quite successful at it, and if we were to target Somali pirates, then allowing companies to raid wealthy Somali investors in Somalia or elsewhere would be key. But then that would require special agreements with those countries that these investors are hiding in. The LoM would have to be very specific and comprehensive in this regard.

Or, the issuing party could throw in bounties and create a false market out of the whole thing. To artificially attach value to these targets, as well as allow companies to seize assets. That to me would be optimum, just because you really have to sweeten the pot for companies to get involved with this thing. Perhaps the 10 percent that governments would receive via prize courts, would go back into the pot for bounties and costs of running prize courts?  Raising money for bounties is a factor when creating artificial values of targets.

I also applaud the author for identifying how expensive the current Defense Industry is for maritime security. I have mentioned in the past that DI’s are costly, and they do nothing to eliminate the problem. If anything, DI’s profit from the continuation of war or piracy, and it is against the best interest of these participants to remove the very thing that gives them their reason for existence. But DI’s have their place, and I believe that in order to reduce the costs of DI, you need to also implement an offensive capability. You will always need guards to protect that in which you love, but you must also have a force tasked with hunting the bad guys–to keep them off balance and put them on the defense. And ultimately, you would like to make piracy into a very unprofitable game for all parties thinking about getting into that business.

Finally, I would like to add one more deal to this review, just to emphasize the significance of profit and reward in warfare. This quote comes from Sun Tzu.

Now in order to kill the enemy, our men must be roused to anger; that there may be advantage from defeating the enemy, they must have their rewards…Therefore in chariot fighting, when ten or more chariots have been taken, those should be rewarded who took the first. Our own flags should be substituted for those of the enemy, and the chariots mingled and used in conjunction with ours. The captured soldiers should be kindly treated and kept….This is called, using the conquered foe to augment one’s own strength.- Paragraphs 16, 17, 18, Chapter 2, ‘Waging War’.

Even Sun Tzu understood the value of reward in war.  Might I add that the interpretation of ‘rewards’ refers to spoils, and not some ideological reward of just ‘winning’. Although that has it’s place for incentive, but feeling good about a win does not pay the bills as they say. lol

I should also note that Sun Tzu also delved into the concept of the cost of protracted war. It is expensive, and if there is no element of a strategy focused on eliminating an enemy, and industry is only used for defense, then the costs will continue to drain the treasures of those nations and companies with interest in the matter.

There is no instance of a country having benefited from prolonged warfare…It is only one who is thoroughly acquainted with the evils of war that can thoroughly understand the profitable way of carrying it on. –Paragraphs 6,7, Chapter 2, ‘Waging War’.

That pretty much sums up why wars should be fought as quickly as possible, and why there should be thought about creating an industry that profits from ending it, and not ‘carrying it on’. Something to give balance or even counter strong DI’s that come about from prolonged warfare. –Matt

Technology: Urgent Tweet In Kenya Village–Help, Sheep Missing

This is another great use of technology and leveraging the established networks and their personal technologies to increase the security and commerce in a rural place. Notice the tools being used?  Basic cell towers, cellphones with SMS capability, basic low cost cell services, and an administrative chief building a snowmobile out of all of those pieces. The end result is that a government can communicate with it’s people, and the people can communicate back. A people scattered and remote, yet still brought closer together because of technology like this. That network has now increased it’s security and commerce, because it can plan and react based on better information coming in.

Some other things with this is that the local populations are using this technology and getting educated on all the various ways of connectivity with the tools they have. They have learned how to post a tweet using their text messaging feature and basic services on their phone. Wow, that is awesome. Just imagine each village with a smart phone or computer?  It will happen, they will learn how to use it and exploit it, and governments need to pay attention. It empowers the citizenry, and it empowers the government to react to the needs of that citizenry. Doom on that government that does not pay attention to this interconnected and knowledge empowered citizenry. Especially if a government has depended upon it’s people not knowing what it is doing, or what it has done in one city/region versus the other. The light is definitely threatening the darkness…..

I also like the addition of this technology to what is already popular and available. That would be radio. A broadcast on a radio can now be met by a population that can answer back with their cellphones. That is quite the capability if used correctly. You could create offense industries with that set up, and possibly use RIM and these networks to find guys like Joseph Kony and his army. –Matt

 

Urgent tweet in Kenya village: Help, sheep missing

When the administrative chief of this western Kenyan village received an urgent 4 a.m. call that thieves were invading a school teacher’s home, he sent a message on Twitter. Within minutes residents in this village of stone houses gathered outside the home, and the thugs fled.
“My wife and I were terrified,” said teacher Michael Kimotho. “But the alarm raised by the chief helped.”
The tweet from Francis Kariuki was only his latest attempt to improve village life by using the micro-blogging site Twitter. Kariuki regularly sends out tweets about missing children and farm animals, showing that the power of social media has reached even into a dusty African village. Lanet Umoja is 100 miles (160 kilometers) west of the capital, Nairobi.
“There is a brown and white sheep which has gone missing with a nylon rope around its neck and it belongs to Mwangi’s father,” he tweeted recently in the Swahili language. The sheep was soon recovered.
Kariuki said that even the thieves in his village follow him on Twitter. Earlier this year, he tweeted about the theft of a cow, and later the cow was found abandoned, tied to a pole.

Building Snowmobiles: Recursive Incentive Mechanism For War, Business, And Crime Fighting

It has been awhile since I last did one of these posts. I think this one is a good one and it definitely got my mental juices flowing. In the past, I have talked about Offense Industry and how bounties are a great way to fire up an industry that profits from the destruction of a specific enemy. Well for this deal, the folks at DARPA and MIT came up with a type of bounty system that takes the whole concept to the next level.

Basically what DARPA did was to set up a contest that revolved around time critical social mobilization. The idea here is that they would have these ten red weather balloons located all over the country, and the team that was able to find all ten (or the most) balloons the fastest won. DARPA wanted to see how fast something could be found.

Now why would DARPA be interested in this?  Well if you are a student of warfare and a reader of this blog, you would remember the New Rules of War post. The second rule listed by John Arquilla was ‘finding matters more than flanking’.

Rule 2: Finding Matters More Than Flanking.
Ever since Theban general Epaminondas overloaded his army’s left wing to strike at the Spartan right almost 2,400 years ago at Leuctra, hitting the enemy in the flank has been the most reliable maneuver in warfare. Flank attacks can be seen in Frederick the Great’s famous “oblique order” in his 18th-century battles, in Erwin Rommel’s repeated “right hooks” around the British in North Africa in 1941, and in Norman Schwarzkopf’s famous “left hook” around the Iraqis in 1991. Flanking has quite a pedigree.
Flanking also formed a basis for the march up Mesopotamia by U.S. forces in 2003. But something odd happened this time. In the words of military historian John Keegan, the large Iraqi army of more than 400,000 troops just “melted away.” There were no great battles of encirclement and only a handful of firefights along the way to Baghdad. Instead, Iraqis largely waited until their country was overrun and then mounted an insurgency based on tip-and-run attacks and bombings.
Thus did war cease to be driven by mass-on-mass confrontation, but rather by a hider-finder dynamic. In a world of networked war, armies will have to redesign how they fight, keeping in mind that the enemy of the future will have to be found before it can be fought. To some extent this occurred in the Vietnam War, but that was a conflict during which the enemy obligingly (and quite regularly) massed its forces in major offensives: held off in 1965, defeated in 1968 and 1972, and finally winning in 1975.
In Iraq, there weren’t mass assaults, but a new type of irregular warfare in which a series of small attacks no longer signaled buildup toward a major battle. This is the path being taken by the Taliban in Afghanistan and is clearly the concept of global operations used by al Qaeda.
At the same time, the U.S. military has shown it can adapt to such a fight. Indeed, when it finally improved its position in Iraq, the change was driven by a vastly enhanced ability to find the enemy. The physical network of small outposts was linked to and enlivened by a social network of tribal fighters willing to work with U.S. forces. These elements, taken together, shone a light on al Qaeda in Iraq, and in the glare of this illumination the militants were easy prey for the small percentage of coalition forces actually waging the campaign against them.
Think of this as a new role for the military. Traditionally, they’ve seen themselves largely as a “shooting organization”; in this era, they will also have to become a “sensory organization.”
This approach can surely work in Afghanistan as well as it has in Iraq — and in counterinsurgency campaigns elsewhere — so long as the key emphasis is placed on creating the system needed for “finding.” In some places, friendly tribal elements might be less important than technological means, most notably in cyberspace, al Qaeda’s “virtual safe haven.”
As war shifts from flanking to finding, the hope is that instead of exhausting one’s military in massive expeditions against elusive foes, success can be achieved with a small, networked corps of “finders.” So a conflict like the war on terror is not “led” by some great power; rather, many participate in it, with each adding a piece to the mosaic that forms an accurate picture of enemy strength and dispositions.
This second shift — to finding — has the potential to greatly empower those “many and small” units made necessary by Rule 1. All that is left is to think through the operational concept that will guide them.

So as you can see, finding an enemy that hides amongst the population is crucial if you want to kill or capture him. It is also difficult for just one person to find an enemy, or enemy network. But if you can create a network of people to find one person or an enemy network, then that is gold.  It also lends itself to the concept of ‘it takes a network‘, to defeat a network.

I also think bounty systems, if done correctly, can involve a large portion of the population in the fight or whatever task. It stands to reason that a nation that can fully tap into the people power it has, as opposed to only depending upon select agencies or it’s limited law enforcement resources, will have way more capability when it comes to the task of ‘finding’ someone or something.

There are also examples of private industry and government using bounties or similar incentive mechanisms to find solutions to problems.  The X Prize Foundation is just one example of this kind of incentivizing process. They have held contests for all sorts of amazing deals, and definitely read through their wiki I posted to check those out.

But back to the title of this post and what I wanted to get too. This DARPA competition drew in 50 teams from all over the nation, but it was the MIT team that won the contest. My intent with this post is to highlight their winning strategy and explore other possible uses for their strategy. To basically chalk this one up as a new bounty type system that companies and government could use to great advantage.

What the MIT team did was to create a bounty system that not only paid those that found the balloon, but also paid those that helped in the finding process. And that payment system was flexible, based on how many folks were involved, and how much money was available for the process or was desired to spend. MIT used what is called ‘Recursive Incentive Mechanism’ or RIM, and they blew away the competition with this method.

Here is a description of what they did:

Only MIT’s team found all 10 balloons. To get the recruiting ball rolling, the researchers sent a link for the team’s website to a few friends and several bloggers about 36 hours before the contest began.
Portions of the $40,000 winner’s prize were promised to everyone who contributed to the search. A maximum of $4,000 was allocated to finders of each balloon — $2,000 to the first person to send in the correct balloon location, $1,000 to the person who invited the balloon finder onto the team, $500 to whomever recruited the inviter, and so on.
Participants received about $33,000 for their efforts.
The number of Twitter messages mentioning the MIT team rose substantially the day before the contest and remained elevated until the competition ended, a sign that the reward strategy worked, Pentland says.

It kind of looks like a pyramid scheme of sorts? lol But the power that comes with this, is the involvement of social networks in the finding of something or someone, all with the lure of making some money and spreading the wealth amongst your network. And what is cool, is that this bounty system benefits different types of folks.

You might be really good at recruiting ‘finders’, so of course this system will benefit you. You might be extremely active on Facebook, Twitter, a blog, and whatever, and have a massive network in place to tap into for spreading the word (hence why I post the bounty stuff on the blog from time to time). On Facebook, I could totally see stuff like this spreading like wildfire. So you could be the guy that made money from just spreading the news. Or you could be the one that actually found the balloon, and score that way. All of these actions helped to form an efficient ‘finding system’ that won the contest.

It is the speed at which all of this happened, which is amazing to me and something to ponder.

For war, the way I could see this being used is to create a more efficient bounty hunting system. Either to find enemy combatants, or to find recruits for the war effort. And as the rest of the world continues to be inundated with cell phones, and now smart phones, the ability to really reach out to them, and have them communicate back is there. An effective RIM could be the key to getting people sending in tips, or involving their personal networks for ‘finding’ the enemy, or getting new recruits for a military in need of man power.

For business, and especially our industry, I could see this being used for head hunting. Meaning if a company is looking for a specific type of unique individual, with a certain amount of qualifications and experience, then a recruiter using RIM might be able to find that individual and in a very fast and efficient way. They could also use the formula that Alex Pentland and his team created so that they only spend the amount of money they are willing to use for the finding operation.

A company could also use RIM for finding innovations or even new business.  Especially in today’s economy, and especially with how dangerous the world has become. In other words, a company can incentivize social networks to accomplish their goals.

Finally, for crime fighting, I think it would be interesting to see the Rewards For Justice program utilize RIM. The current bounty system is old and only focuses on the individual tipster. Perhaps RIM could help to fire up that program, and get more of the population involved in finding criminals.  Crime Stoppers could turn to such a system as well, because they too use a very simple bounty system that only caters to individuals.

Interesting stuff, and I think it is a concept worth researching. Also, if you look further into Alex Pentland’s research on ‘reality mining‘, you will see why they were able to come up with the winning system. They were leagues ahead of their peers when it came to understanding the human dynamic, and they knew it. Here is the quote that I liked:

“It was trivial for us to slap together the balloon thing,” says the 58-year-old Pentland. That’s because other groups’ tactics were based on guesswork, he argues. His were based on lessons learned through data-mining research. “We won because we understood the science of incentivizing people to cooperate.”
Since 1998 Pentland has been engaged in an unusual blend of sociology and data mining that he calls “reality mining.” His researchers place sensors that he’s dubbed “sociometers” around hundreds of subjects’ necks and install tracking software into their cellphones, capturing the movements of every individual in a group, whom he or she interacts with, even body language and the tone of his or her voice. Then they mine the resulting reams of data to identify facts as elusive as which member of the group is most productive, who is the group’s real manager or who tends to dominate conversations.
“Data mining is about finding patterns in digital stuff. I’m more interested specifically in finding patterns in humans,” says Pentland, who has a Ph.D. in artificial intelligence and psychology from MIT. “I’m taking data mining out into the real world.”

Very cool and I look forward to your thoughts on RIM? Don’t ask me to interpret the math of the thing though. lol Just read through the paper and if you can understand the proofs, then good on you. All I know is that RIM won the contest, and that is what is most important to this discussion. I also think that Pentland could probably come up with a custom tailored system for war, business, or crime fighting, and perhaps some kind of modified RIM is what he would come up with. Online pay strategy quickly coordinates cross-country balloon posse

These days, bounty hunters aren’t deputized, they’re digitized: Online crowd-sourcing strategies to induce masses of people to solve a task, such as locating far-flung items or alleviating world hunger, work best when financial incentives impel participants to enlist friends and acquaintances in the effort, a new study concludes.
In a competition to find 10 red weather balloons placed across the United States, a team of MIT researchers used online social media and a simple reward system to recruit balloon-searchers in the 36 hours preceding the contest. Their pay-based strategy garnered them 4,400 volunteers who located all the balloons in a contest-winning eight hours, 52 minutes.
“Our incentive system offers monetary rewards, but perhaps more importantly it builds social capital between you and the people you recruit, who get an opportunity to participate in something interesting,” says MIT computer scientist Alex Pentland. This strategy could boost the effectiveness of humanitarian and marketing campaigns, Pentland and colleagues conclude in the Oct. 28 Science.

Leadership: A Command Culture And Philosophy Called ‘Auftragstaktik’

A command and control procedure within which the subordinate is given extensive latitude, within the framework of the intention of the individual giving the order, in carrying out his mission. The missions are to include only those restraints which are indispensable for being able to interact with others, and it must be possible to accomplish them by making use of the subordinate’s forces, resources, and the authority delegated to him. Mission-oriented command and control requires uniformity in the way of thinking, sound judgment and initiative, as well as responsible actions at all levels.- German army regulations describe Auftragstaktik, from Parameters.

Part of what makes this blog so fun and interesting is the hunt for the great idea. I don’t care where it comes from, or who came up with it–to me, it is all about logic and reason. Either the idea is sound, or it is not. It should also be able to withstand the furnace of debate and scrutiny. Hence why I post such things.

But this is a simple concept to wrap your brain around, and yet so difficult to implement in institutions like the US military or various companies. To put this much freedom of operations into the hands of a leader is pretty tough for some CEO’s or Generals to handle. And as the author presented below, the German Army during WW 2 was the victim of a officer corps that was poorly constructed. But at the tactical level, the German Army was amazing, and this concept of Auftragstaktik is a big part of that.

Anyways, I will let the reader make their own determinations based on the articles below. The first is the most modern article on the concept and a big hat tip to Jorg Muth and Thomas Ricks for getting it out there. The second article is an old one, written by a German soldier and veteran of WW 2 named Gerhard Muhm. He went into detail on how Auftragstaktik was used in the German Army at the time. The final article is a snippet from Wikipedia, which will help to simplify and focus the reader on the core concepts.

It is also important to note that Intent is a very important theme in today’s military’s. It is the idea that everyone in the unit knows the intent or the mission and what must be accomplished. Commander’s intent is another way of putting that. There is a whole study on intent at wikipedia, and it is definitely worth your while to go through it to get a feel on how important it is to the various military units of the world.

Intent is a key capability in 21st century military operations and is a vital element to facilitate subordinates initiative (U.S Army 2003, para.1-69), self-synchronisation (Alberts et al. 1999, pp.175-180) and collaboration and cooperation (Alberts and Hayes 2007,pp.109-114) amongst team members in joint operations.

Now how does this apply to private industry or even offense industry?  Well interestingly enough, there is a a lot of auftragstaktik going on already with private industry. No one tells companies how they are supposed to perform static security, convoy operations, or PSD. Even within companies, you see differences in mission accomplishment between the various contracts. So that is a very positive aspect of today’s PMC’s and PSC’s. Personally, I have seen the same missions accomplished differently in a multitude of companies that I have worked for. It is what makes the industry interesting to observe and be a part of. But as a result of these variations, private industry is able to evolve and develop SOP’s that are unique and effective. We also have some cross breeding going on with SOP’s/ideas, just because contractors are taking what they learned from prior contracts and bringing that with them to the next job for mission accomplishment.

On the flip side, our Defense Industry is purely focused on the ‘defense’. Which is fine, but it does not eliminate the enemy or reduce their numbers. For that, you need to create a Offense Industry, and concepts like Auftragstaktik or company intent will be very important to the accomplishment of a contract in this type of industry. It is also important to set up an offense industry that supports the intent of the principal or the country firing up such a machine. In other words, a country that constructs a offense industry should not be involved in telling companies ‘how’ they are to accomplish the task.

A great example is Executive Outcome’s contract in Sierra Leone. Would they have been successful if SL told the company how they were to accomplish the task?  I don’t think so, and that would defeat the reason for hiring such a company in the first place. You give them the intent, and let them figure out the ‘how’.

Now of course this concept is not a strategic concept as the articles have mentioned below. Which is very important to remember if a offense industry is to be created. Countries must first have a sound strategy in place, and the offense industry must be assembled in such a way to support that strategy.  That is a whole different post, but I guess where I am going with this is that what makes offense industry such a powerful concept is the idea of allowing companies the freedom to innovate and figure out how to accomplish the task.

Not only that, but they also have ‘incentive’ to do well. The goal should be to give them the intent, establish rules and boundaries that insure they do not hinder the overall strategy or harm other friendly units, provide adequate incentive, and set the industry free to accomplish the task. Then adjust and modify as necessary–all based on Kaizen and having a sound learning organization. –Matt

Auftragstaktik. The word sounds cool even when mangled by an American tongue. What it means, however, has always been elusive to Americans. The problematic translation of that core German military word into “mission type orders” completely distorts its meaning. Auftragstaktik does not denote a certain style of giving orders or a certain way of phrasing them; it is a whole command philosophy.
The idea originates with Frederick the Great, who complained after more than one battle that his highly experienced regimental commanders would not dare take action on their own but too often ask back for orders and thus waste precious time.
Nearly one hundred years later the military genius Helmuth Karl Bernhard Graf von Moltke was the first to formulate the concept of Auftragstaktik. Moltke was a diligent student of Frederick’s campaigns, of military history in general and philosophy. At a time when he was not yet famous and, not yet the victor of three wars, he observed the annual General Staff war games in 1858. The paperwork and the detailed orders appalled him because he knew that in war there was no time for such nonsense. During the war game critique he decreed that “as a rule an order should contain only what the subordinate for the achievement of his goals cannot determine on his own.” Everything else was to be left to the commander on the spot.

Bounties: Libyan Rebel Offense Industry–Gaddafi Wanted Dead Or Alive For $1.67 Million

Now this is one of those deals where I am sure anyone with a gun that is on the ground in Libya could participate in this bounty? But it sounds like the rebels are really trying to reach out to his inner circle folks by offering amnesty and money. We will see and it just might produce. In Iraq, a bounty certainly helped to find Uday and Qusay. Although that bounty was worth $30 million. Maybe some more donors will add to the Gaddafi bounty?

I must add that there have been prior reports of bounties on Gaddafi. This report stated 10 million pounds. So maybe this could be added if true? Either way, the bounty I just reported has proof via a press release. –Matt

Libya: Rebels put £1m bounty on Gaddafi’s head
Libya’s rebel council has offered a £1m reward for the capture, dead or alive, of deposed ruler Colonel Gaddafi.

The rebels will also give amnesty to members of Gaddafi’s close circle who kill or capture him, Abdel Jalil, the chairman of the Transitional National Council said today.
The bounty of two million Libyan dinars (£1m, $1.67m) was offered by two businessmen from Benghazi.
“The National Transitional Council announces that any of his inner circle who kill Gaddafi or capture him, society will give amnesty or pardon for any crime he has committed,” chairman Jalil said.
Today there was heavy fighting in the south of Tripoli as rebels hunted the dictator.
“We think Gaddafi is hiding somewhere in Tripoli. He is likely to be in the al-Hadhba al-Khandra area,” an official said.
