International bounty hunters for war criminals: privatizing the enforcement of justice

I. INTRODUCTION

International law is often criticized for lacking any formal means of enforcement. [1] International criminal tribunals are not supported by an international police force. Many of the individuals indicted by the International Criminal Tribunal for the former Yugoslavia (ICTY) remain at large, [2] and the Yugoslavian government has systematically refused to arrest indicted war criminals. [3] Even the October 2000 popular uprising that ousted Slobodan Milosevic from Yugoslavia’s presidency has done little to improve Yugoslavia’s level of cooperation with the ICTY. Mr. Vojislav Kostunica, Yugoslavia’s newly elected president, has not permitted Serbs to be extradited to The Hague. [4] Mr. Kostunica has stated that a Yugoslavian national truth commission should address Yugoslav war crimes. [5] The departing president of the ICTY, Gabrielle McDonald, has criticized the United Nations Security Council (UNSC) for “doing too little to help bring indicted people to justice.” [6]

Legal News: Bush Commutes Prison Sentences of 2 Ex-Border Agents

   This is fantastic news, although I would have liked to have seen a pardon for these guys instead of just commuting the sentences.  I am sure the families are happy, and this was still pretty cool.  –Matt

Bush Commutes Prison Sentences of 2 Ex-Border Agents

Jan. 19 (Bloomberg) — President George W. Bush, on the eve of leaving office, commuted the sentences of two former agents of the U.S. Border Patrol who were convicted of shooting an unarmed Mexican drug smuggler as he attempted to flee.

Ignacio Ramos and Jose Alonso Compean were sentenced last November. Compean was given a 12-year term on charges including assault with a dangerous weapon and aiding and abetting a crime; Ramos was given a term of 11 years and one day on similar charges. The commutation reduces their prison terms to time- served as of March 20.

Their case became part of the debate over illegal immigration and attempts to rewrite U.S. immigration law.

They were convicted of assaulting an unarmed Mexican national, Osvaldo Aldrete-Davila, who was shot in the buttocks in 2005 as he attempted to flee back to Mexico after being stopped inside the U.S. border with a van loaded with marijuana, according to the U.S. attorney’s office.

In a Sept. 11, 2008 statement about the case, U.S. Attorney Johnny Sutton said the two agents “shot 15 times at an unarmed man who was running away and posed no threat.” The agents “lied about what happened, covered up the shooting and then proceeded to write up and file a false report,” he said.

Aldrete-Davila was sentenced to nine years and five months in prison for conspiracy to import more than 100 kilograms of marijuana and related charges.

TV show latest offbeat tactic for Arizona sheriff

PHOENIX (AP) — In Arizona, seeing Joe Arpaio on TV is nothing new. But the self-described “America’s toughest sheriff” now has a national platform to pursue lawbreakers that stretches beyond the 5 o’clock news.

The Maricopa County Sheriff’s Office, which oversees the state’s most populous county, has a starring role in “Smile … You’re Under Arrest!,” a new reality show debuting Saturday on Fox Reality Channel.

A cross between “Punk’d” and “Cops,” the program sets up elaborate sting operations to snare people wanted on outstanding warrants. Actors and undercover deputies play along in faux scenarios where scofflaws are enticed to have a good time; the drama comes when cast members reveal the prank and waiting deputies slap on handcuffs.
