Legal News: A Scuffle Between Security Contractors and Iraqis in the Green Zone

The New York Times editorial board has called the SOFA’s exclusions of protection for contractors “an acceptable price to pay to show this country’s commitment to the rule of law.” A diplomatic concession that blatantly and offensively treats one class of American citizen differently than others hardly demonstrates the U.S. commitment to the rule of law.

What it does demonstrate is that the U.S. government was eager to get a SOFA signed, so as to claim progress on the path to Iraqi sovereignty. To get it signed, the U.S. government made an enormous concession as to the due process rights of one currently unpopular class of its citizens: contractors. By so conceding, we achieved a document we can point to and claim that Iraq is sovereign. Iraqi sovereignty was our stated goal in Iraq. This SOFA is just one last way for us to wave a “Mission Accomplished” banner. –Tara Lee, From the Jurist

   The other day, I was trying to get Tara Lee’s opinion about what is going on here legally.  What are the laws and basic human rights violated in this incident, that would fall under either the SOFA or UCMJ?  My guess is that there isn’t much these guys can do, and I really haven’t seen any new interpretations of the SOFA or UCMJ as it applies to contractors. Tara was one of the few that really had this stuff nailed during the time we signed the SOFA, and she was a lone supportive voice in the sea of negativity regarding what security contractors do.

(NYSE:DCP), has entered into a definitive agreement to acquire 100% of the stock of Phoenix Consulting Group, Inc. Phoenix provides its proprietary training courses and materials and management consulting and augmentation services to the intelligence community. Terms of the transaction were not disclosed. The acquisition is expected to expand DynCorp International’s services to the intelligence community and national security clients. DynCorp International intends to fund the purchase price with cash on hand.

Industry Talk: PSI, DynCorp, AECOM, and PAE win AFRICAP Contracts

     The program encompasses logistics support, construction, military training and advising, maritime security capacity building, equipment procurement, operational deployment for peacekeeping troops, aerial surveillance and conference facilitation. Potential contractors must possess a broad range of functional regional expertise and logistics support capabilities.      The big story here is AFRICAP, and what the hell is it? I posted some open source stuff on the contract below. From the quote up top, you get an idea of what this contract is all about. The program has 1.5 billion dollars attached to it, so this is pretty significant.

    The other news is PSI coming on to the scene as a player. From TWISS 2 to AFRICAP, they will be busy. My question is who do they know, because winning these two contracts back to back like this is impressive. That company is going to be spinning up a ton of jobs, so definitely keep your eyes on them over the next couple years.-Matt

Leadership: Amid Reviews, DynCorp Bolsters Ethics Practices

     Glad to see DynCorp taking these steps and I hope they make good with their promise of ‘strengthening it’s ethics programs’.  But what DynCorp really needs to focus on, is insuring they hire the right folks into positions of management.  The quality of leadership out there is what will make or break your company out there.  Some ethics program manager posted in a nice comfortable office at headquarters will not be an effective tool for monitoring your management.

     It is a nice visual step, but the focus needs to be on the folks that will implement your ethics policies in the first place–the leaders.  And if your high paid managers suck, then get rid of them.  Matter of fact, get rid of the regional manager in charge of that guy as well, because obviously he didn’t care enough about company policy or doing things right to keep things in check. Remember the Sun Tzu and the 360 Concubines story I posted?  Well have the courage to do what is right, and get rid of your poor managers with authority.

    Send the message to your leadership that you demand excellence, and the rest will follow. You actually have to care about what is happening out in the field, dedicate the necessary resources to monitor what is going on out in the field, and correct things as quickly as possible.
