Logistics: US And NATO Making Deals With Russia, A New Rail Line, And Getting Closer To Dropping Pakistan Routes

     At the moment, about half those supplies come through Pakistan. The Pakistanis only closed, for about a day, one of the two main routes. About 30 percent of the supplies come in via Central Asia railroads, and another comes from the Black Sea, via rail to the Afghan border. The remaining 20 percent comes in by air. But some of that may be shifted to the Central Asian route, which is much safer (from bandits, bad roads and the Taliban) than the Pakistan routes.

     The U.S. and NATO supplies coming in via railroad from Western Europe, go through Ukraine, Belarus, Russia, Kazakhstan and Uzbekistan, to Afghanistan. This approach costs $400 a ton to get supplies into Afghanistan, versus three times that to truck it in from Pakistani ports, or $14,000 a ton to fly stuff in. This Central Asian route has been under negotiation since 2003, but Russia kept agreeing to it, and then withdrawing cooperation. What has finally compelled Russia to cooperate in the last year is the growing problems they are having with heroin and opium coming out of Afghanistan into, and through, Russia.-From Strategy Page

    Boy, this latest deal with Pakistan shutting down the border after the cross border accident is any indicator as to how unstable the logistics route is, then news like this should be good for the US and NATO. Although any deals they make with Russia will have to piss off Georgia, whom has contributed forces to the war effort. It is also risky to now make Russia a partner with all of this, because they could play games with the rail system. I guess they would be the best route to go with out of the two bad options available.

    The other point is that Russia is very smart when it comes to leverage and negotiations. The more we have issues on the Pakistan border with crucial logistics, the more the coalition is up against the wall to use a different route–and they don’t have many options. Especially when cost is increasingly becoming an issue. So at this point, Russia is going to negotiate all types of sweet deals in regards to NATO and how it impacts Russia. I just hope that whatever deals we strike up, that the US and NATO don’t get screwed in the long run. Russia knows it has the cards.

    On the flip side, I just posted a deal on Russia thinking about using private security firms for their companies overseas. I could see them utilizing these types of paramilitary forces for work in Afghanistan, if in fact the US and NATO could convince them to participate. Russian troops in Afghanistan would be too much to ask I think. You never know though and I never cease to be amazed with this stuff.

     I also mention private industry as a better option because of all of the Mi-17s that Afghanistan is buying up. Russia would be a good choice for instructors and maintenance types in these contracts to ensure that Afghanistan gets a good value. Plus, the Russians wrote the book on using the Mi-17 in Afghanistan during their war there and these Mi-17s are familiar to the Afghans. Most of all, there is the maintenance of these aircraft post war.  Poor countries with little in the means of parts or repair capability, will really appreciate the durability, cost and simplicity of this aircraft when everyone is gone and packed up.

     Afghanistan will also appreciate all of these railroads coming into their country, because that will make it significantly cheaper for investors to do business there.  The US and NATO will enjoy a cost savings as well, just as long as Russia is happy, and the Taliban can be put in check in the north. From the northern Afghan city of Mazar-e Sharif to the Uzbek border, the land runs flat with barely a hillock to block the way.

It is perfect terrain for building a railway. So, since Afghanistan inaugurated construction of its northern rail line in May, progress has been fast.

Now, the Uzbek company contracted to lay the track has completed almost all of the 75-kilometer line. According to the schedule, the construction should be finished by the end of this year.

If so, Afghanistan will get its first railroad in more than 100 years. That is when a former monarch, Amir Abdurrahman, banned rail lines as potential invasion routes.

Officials say the railroad will speed up freight deliveries across the Uzbek border dramatically.

Industry Talk: Afghan Ban On Security Firms Delayed By 2 Months

     That’s a start. Although I wonder how much we had to pay Crazy Karzai for this two month extension? lol Lately I have been reading all the latest articles about this circus, and it is just dumb. It is obvious that Karzai is playing games. I mean this guy is talking with the Taliban, getting money from Iran, and at the same time jerking us around about PSCs in Afghanistan.  He is using the ban on PSCs as a means of extortion and it is just dumb. It’s almost as if some agent was able to penetrate his brain and plant this idea, ‘Inception‘ style.

     Because lets be real on this one. Karzai’s life was dependent upon private security during many of the years of his presidency. His family operated private security companies who made millions of dollars from contracts over the years. And all of these recent incidents involving kidnapping, attacks on facilities, and attacks on convoys all highlight how important security is. If there are not enough troops to do the job, then of course private security is the next step, and yet Karzai wants to ban them?

     Also, if Karzai has an issue with companies, then instead of throwing the baby out with bath water, he could instead ‘fairly’ issue licenses (which they do, yet does not regulate or manage well ) and require them to be bonded. A bond could make it extremely expensive for companies that screw up, and give the offices an incentive to watch the industry. That would be one way for him to control and regulate companies.

     The alternative is that he kicks out all of these companies, to include expat companies, and all of the programs they were tasked with securing will falter. Billions of dollars in aid designed to rebuild and infuse money into the local economies, will now be shut off because these programs do not have security. Not to mention investors will now have second thoughts about doing anything in Afghanistan, all because they are not allowed to use private security.

     The logical way to reduce the numbers of contractors is through success in the war. As security increases, attacks and threats decrease, and the requirement for security will decrease. Actually this would be a great metric on how the war is going, and if security contractor use naturally decreases because of that classic market force called ‘a lack of demand’, then this would be an excellent indicator that things are getting better.

     It is a lot like the timeline issue that I have talked about in the past. The enemy loves timelines, because it is a date for victory. Troops or contractors should leave not based on timelines but based on progress and success. –Matt

 Arg, Kabul – For a rapid implementation of Presidential Decree 62 on the dissolution of private security companies, President Hamid Karzai has ordered the establishment of a committee led by the Minister of Interior and participated by representatives from NATO-ISAF and major international donors.

The Committee will develop plans for the disbandment of the PCSs that provide security for development projects and report on progress to the President.

The phasing out of illegal PCSs and road convoy security companies continues on a priority basis as laid out in the Decree.

Recognizing the importance of maintaining the continuous delivery of critical development projects and programs funded by the international community, the Committee will prepare a timetable for the disbandment of the PCSs that secure development projects and submit it to the President on November 15th, 2010.

Legal News: Efforts To Prosecute Xe Are Collapsing

     Interviews with lawyers involved in the cases, outside legal experts and a review of some records show that federal prosecutors have failed to overcome a series of legal hurdles, including the difficulties of obtaining evidence in war zones, of gaining proper jurisdiction for prosecutions in American civilian courts, and of overcoming immunity deals given to defendants by American officials on the scene.

     “The battlefield,” said Charles Rose, a professor at Stetson University College of Law in Florida, “is not a place that lends itself to the preservation of evidence.”

     This is very interesting and troubling from a legal standpoint. This will just add to the argument against this industry that we are above the law or immune from any wrong doing.

     I am speaking for myself here, but I am sure others will echo the same sentiment. I do not view us as above the law or unaccountable, nor do I want to be looked at as ‘above the law or unaccountable’. I want us to be accountable, and the public that pays the taxes that is used by congress to contract our services in war zones must also be assured that we are accountable.

     As it stands now, the government has yet to figure this stuff out and we continue to be demonized and discredited for our service in the war. That means the security contractors who died in the war, as well as the living will continue to be looked at as less than or illegitimate. That is why it is extremely important that a legal mechanism is established that actually works.

     Now of course the justice system ran it’s course with the ruling of this individual who shot the Iraqi bodyguard. But if the DoJ can’t prosecute such a simple and clear cut case, then how does that translate with other similar cases?

     I also want to hold the FBI to some accounting as well.  If evidence in a war zone is needed, then send agents to that war zone and collect it. They can call upon military police in those jurisdictions to help. For the whole immunity deal, it needs to be made clear exactly who can give that kind of immunity and in what circumstance. This is where congress can intervene and dictate exactly how that is to be done.

    Another point to make is on the big picture. Our enemy continues to be released from Gitmo because of a lack of ‘war zone evidence’ or whatever, and they go right back to the battlefield and kill more soldiers or innocents. I don’t agree with this legal policy as well. In both the contractor and terrorist cases, a lack of coherent legal mechanisms that everyone can agree upon is not good.

     I also think that politics have certainly gotten in the way of forming and deciding upon coherent legal mechanisms. If one side thinks military tribunals is sufficient, and the other side thinks federal courts is better, and we continue to do the slow slog of debate and deliberation on determining the best way, well then the war time strategy will suffer and more people will die. Figure it out folks, because that is your job and lives depend upon it.

    Likewise, the security contracting industry has been extremely active and highly depended upon in this war, and yet an effective legal mechanism by which to govern this industry has yet to be established. I don’t get it? Especially when there is precedent for establishing a legal mechanism called Article 1, Section 8, Paragraph 11 in the US Constitution. Granting a LoM is the duty of congress, and yet they have completely shirked this duty and passed on the establishment of legal mechanisms governing contractors upon the various agencies of government. Talk about passing the buck? And look how much confusion this has created?

     A LoM could have dictated exactly what laws and legal mechanisms congress wanted contractors to fall under. A LoM could also have an expiration date and be re-granted from year to year just so it stays current and based on the newest legal issues of the day. But the best part of it is it is a power granted to congress and would give them the ultimate control over the companies who wish to obtain extremely valuable government contracts. No middlemen or agencies, no lobbyists–just congress and a company in a room hashing out a reasonable LoM. If congress wants a company to fall under the UCMJ, it could become an official decree backed by the Constitution and a congress that issued the LoM. If it is MEJA or whatever, congress can make that happen through this legal mechanism.

     Or we can continue to flail in the wind and harm the war effort due to this inaction by congress. –Matt

Efforts to Prosecute Blackwater Are Collapsing

WASHINGTON — Nearly four years after the federal government began a string of investigations and criminal prosecutions against Blackwater Worldwide personnel accused of murder and other violent crimes in Iraq and Afghanistan, the cases are beginning to fall apart, burdened by a legal obstacle of the government’s own making.

In the most recent and closely watched case, the Justice Department on Monday said that it would not seek murder charges against Andrew J. Moonen, a Blackwater armorer accused of killing a guard assigned to an Iraqi vice president on Dec. 24, 2006. Justice officials said that they were abandoning the case after an investigation that began in early 2007, and included trips to Baghdad by federal prosecutors and F.B.I. agents to interview Iraqi witnesses.

The government’s decision to drop the Moonen case follows a series of failures by prosecutors around the country in cases aimed at former personnel of Blackwater, which is now known as Xe Services. In September, a Virginia jury was unable to reach a verdict in the murder trial of two former Blackwater guards accused of killing two Afghan civilians. Late last year, charges were dismissed against five former Blackwater guards who had been indicted on manslaughter and related weapons charges in a September 2007 shooting incident in Nisour Square in Baghdad, in which 17 Iraqi civilians were killed.
