Legal News: DoS Statement On The Comprehensive Contingency Contracting Reform Act Of 2012

This is cool. Patrick Kennedy is commenting on this reform act, which will certainly have an impact on contracts with the government for future and current contingency operations. There is also a video of his testimony.

What is of interest is State’s concern of how this law would negatively impact the flexibility they require in order to deal with today’s problems. The Arab Spring is just one example of how quickly things can change out there. Here is the quote:

With regard to the automatic suspension provisions set out in proposed Section 113, we believe that the current, long-standing policy requiring a reasoned decision from the SDO based on a totality of information remains a sound approach, and would have concerns with a provision that imposes automatic suspension and debarment which will likely lead to due process challenges by the affected contractor community and potential court action that could delay necessary action in crisis situations.
Reorganization of Contracting Function (Sec. 131)
We respectfully do not concur with the re-organization of our contracting function proposed in Sec. 131. Defining the acquisition organization of the Department of State in statute would reduce our flexibility and codify the structure, making future adjustments to support new 21st century challenges cumbersome and time consuming. Future legislation would have to be drafted and passed to allow the Department to adjust to the fast changing world of diplomacy, rendering the Department less agile and thereby potentially handicapping the Department’s ability to respond to contingencies. Also, the proposed re-organization would constitute a bureau with not only the contracting function but logistics, motor vehicles, diplomatic pouch, household effects, shipping and storage. If a bureau were to be formed with only the contracting program, it would not be of sufficient size to warrant bureau-level status.

Probably the most relevant section of the statement to the readers of this blog was point about PSC’s and command and control. Here is the quote:

Private Security Contractors (Sec. 202)
The Department has a long history of using contract guards for protection of facilities and personnel stretching back to the 1970s, with enhanced capabilities in the 1990s. Private security contractors (PSCs) are critical to our readiness and capability to carry out American foreign policy under dangerous and uncertain security conditions. Maintaining this capability is particularly important when the Department is taking on expanding missions in contingency operations environments or areas that are transitioning from periods of intense conflict, such as in Iraq and Afghanistan.
That said, we appreciate the intent of section 202. We have sought to reduce risks associated with using contractors through robust oversight of our PSCs, as in CWC Recommendation 4. Contractors are operationally overseen and contractually managed by direct hire Department of State personnel, and we have instituted cultural training requirements, and contractor behavioral standards of conduct to ensure the professionalism of PSC personnel. The Department is staffed to properly oversee PSC compliance with these contractual requirements in Iraq and Afghanistan.
State strongly disagrees with the language of paragraph Sec. 202 (b)(1), which has the combatant commander determining whether performance of security functions by contractor personnel for the Department of State in overseas contingency areas is appropriate and necessary. This language is too open-ended and is not acceptable as it infringes upon the Secretary of State’s primary role in leading and carrying out foreign policy. The Secretary of State and the Chief of Mission have statutory responsibility for the safety and security of personnel under Chief of Mission authority. We routinely discuss the security situation in-country with DoD and other agencies present at post; and in situations where U.S. military forces are present, that coordination is intensified and ongoing. We fully comply with OFPP’s new Policy Letter on inherently governmental and critical functions, and our PSCs never engage in combat operations. We hope to work with you and your staff to find mutually acceptable language in this section.

What is interesting here is that 202 (b) (1) is a challenge to State’s control over their security force. It also causes confusion over who is really in charge of that force, which is not good in contingency operations.

If anything, the two groups should work together to ensure State’s security force is on the same sheet of music with the mission. Unity of effort is what should be the focus. But the language of this section is vague as to who is really in control of those forces. So I think State has a point here, but that is my personal opinion. Either way, check it out. –Matt

Good morning Chairman McCaskill, Senator Portman, and distinguished members of the subcommittee. Thank you for your invitation to appear here today to discuss Senate bill 2139, the Comprehensive Contingency Contracting Reform Act of 2012.
We share the Committee’s desire to ensure that efforts continue to strengthen contingency contracting. S. 2139 raises a number of important issues. While our review of the bill is ongoing, we welcome the opportunity to discuss our initial views on the bill’s provisions.
We understand that this legislation builds on the recommendations of the Commission on Wartime Contracting in Iraq and Afghanistan – an independent, bipartisan panel that you, Senator McCaskill, created along with Senator Webb in 2007. The State Department worked continuously with the Commission on Wartime Contracting (CWC) from when it was formed in early 2008 until it sunset last August, and gained valuable insight from the Commission’s efforts. We have taken many steps to improve our contingency contracting over the past several years, based on the CWC’s reports, recommendations from other oversight entities, and our own lessons learned.
The Department’s participation in CWC’s study was headed by the Office of the Under Secretary for Management and the Bureau of Administration. In addition to numerous meetings with the CWC, senior Department officials testified at seven formal CWC hearings.

War Art: ‘Shooters’, By Eric Trautmann, Brandon Jerwa, And Steve Lieber

I just came across the news of this comic or ‘graphic novel’, and this sounds cool. From the sound of it, these guys have really tried to produce a quality and detailed product, and the creators definitely have an interesting background.  One of them was Eric Trautmann.

Eric was a writer for Microsoft and helped put together the story lines and dialogue for some famous video games. Here is a quote from his bio.

Among the titles that Eric helped develop were the smash-hit HALO: Combat Evolved (including editing chores on the first three HALO novels for Ballantine / Del Rey, as well as writing The Art of HALO, also for Del Rey); Crimson Skies(creating a strongly immersive in-universe website for the pulpy, two-fisted adventure setting; editing weekly serialized online pulp novellas; and editing and contributing to Del Rey’s mass-market paperback fiction anthology based on the setting); MechWarrior 4; and Perfect Dark Zero, acting as a story consultant to the property and helping to develop a fiction publishing program in support of the game.

He has also written some pretty cool comics and he is a well known author in that community.

What is most significant is that he has a personal connection to this comic and industry via his brother in law and security contractor getting killed in Iraq back in 2005. According to recent reviews, this comic is doing quite well and the author’s passion and personal connection to the subject is coming through in the artwork and words.

I have yet to read a copy, but I figured I would put it out there for folks to check out if they are at their local comic book store or online. You can find this comic for sale in the Jundi Gear store as well. –Matt

 

Shooters

Shooters is an original graphic novel, published by DC Comics’ imprint, Vertigo (home of such acclaimed graphic novels as Preacher, Transmetropolitan, Sandman, The Road to Perdition and many others).
The book follows the career of Terry Glass — a Chief Warrant Officer in the United States Army, and a well-trained Special Forces operator — during the early days of America’s post-9/11 military actions in Iraq.
While in Iraq, Glass’ faces the creeping boredom of the infantryman, the adrenaline-charged terror of direct confrontation with the enemy, and finally, a shattering accident that leaves him both physically and emotionally scarred.
And that is merely the starting point of Glass’ journey.
There’s more than IEDs, enemy insurgents, and bullets to face. Recovering from terrible injuries, Glass faces his own private demons, the ruins of his marriage, and the moral uncertainties of life as a private military contractor.

Iraq War story hits close to home

Tragedy turned comic book writer Eric Trautmann’s fledging story about a private military contractor personal in September 2005.
His brother-in-law, David Shephard, was working for Blackwater USA when he died in Iraq while protecting a State Department official on a security detail.
Shephard’s memory lives on in the 144 pages of “Shooters,” a black-and-white graphic novel that Trautmann co-wrote as “his counterfire against unnuanced portrayals of warfare” related to soldiers and contractors.
The story’s main character is based in part on Shephard, a former Lacey resident, as well as other soldiers Trautmann has met. Portions of the story set in 2003-04 take place at Fort Lewis.
The story centers on a former soldier who returns to Iraq as a contractor as he tries to cope with a traumatic experience during his Army deployment. It revolves around themes of duty and redemption while exploring current issues for an Army strained by two ground wars: post-traumatic stress disorder, a soldier’s adjustment into civilian life and problems at home.
Trautmann, 40, began writing the story as a traditional novel before Shephard’s death. It was his effort to reconcile what he considered the media’s portrayal of military contractors as out-of-control guns for hire with his brother-in-law and other contractors he met who were committed to improving Iraq and the lives of its people.
“War shouldn’t be black and white,” he said. “War is gray, and I wanted the book to be gray and maybe make people think a little bit before automatically assuming that’s a good guy, that’s a bad guy, because the world is too sophisticated and complicated.”

Iraq: No Iraq Visas Issued to USG Security Personnel Since December 2011?

I recently came across a blog post by Diplopundit that was very interesting. They are reporting that no Iraqi Visas have been issued to USG security personnel since December of last year. This is not surprising and I posted about guys getting arrested and hassled last year and this year because of visa/paper work issues. Here is the quote and DoS has yet to refute this or comment over at Diplopundit.

“No visas have been issued to security personnel since December and there is no straight answer coming from the Department of State or the Ministry of Interior.”

What is funny is that the DoS stated this in their travel warning for Iraq.

“The U.S. government considers the potential threat to U.S. government personnel in Iraq to be serious enough to require them to live and work under strict security guidelines. All U.S. government employees under the authority of the U.S. Ambassador must follow strict safety procedures when traveling outside the Embassy. State Department guidance to U.S. businesses in Iraq advises the use of protective security details.

We also know what the Oil Ministry thinks about private security in Iraq. lol

So how is it that anyone can legally provide this security throughout Iraq if they don’t have visas? So I take it that folks are just sitting at the embassy and not traveling throughout Iraq because their security is without a visa? Or I wonder if any other countries have been denied visas and the US is the only one? (There are various oil interests in Iraq, to include China’s, and I wonder how they are being treated?) Military News: Lessons Learned–The Battle Of Ganjgal Valley Simulation

This is an excellent simulation of this battle, and a big thanks to Matt at Facebook for giving me the heads up. Long War Journal also posted this thing, and keep your eyes on the comments there if you want to review feedback.

Might I also add if you didn’t know already, that this was the battle that Marine Dakota Meyer participated in and received the Medal of Honor for. So it is cool to see exactly what went down that day in the form of a video simulation.

As to my comments on the battle? I think the lessons learned posted at the end say it all. Also, from a private military point of view, you can see how important it is for everyone involved in the machine to be on the same sheet of music and to have excellent intelligence to make good plans.

Also, you can see how vital support was to this task force of Marines, Afghan soldiers, and Army. To be able to support your operations versus depending on someone else to arrange that support or give that is the ultimate in self-sufficiency and mobility. Having their own mortars to provide their own organic fire support, or even having drones like the Switchblade would have been nice to have.

Just look at what happens when you have to depend upon a command post operations center that was incompetent or too bureaucratic/inefficient to support a task force like this?  Or look what happens when they are overwhelmed or understaffed?

Another point I wanted to make is Incident Command versus what the military tries to do in war. I think the military could learn from forest fire fighting dispatching centers. They are fast paced, chaotic, and people depend upon a dispatcher’s quick decision making to support fire fighting.

When I was a forest fire fighter back in the day, I got a chance to be a dispatcher. Decisions made in the dispatch center saved lives and property, and we supported operations during times of normal fire activity, all the way up to ‘the entire world was on fire and pure chaos was the result’. lol It is a tough job, and mentally you will be pushed. (it is a multi-tasker’s profession, and women do well at it)

As a dispatcher, you have to understand the needs of those in the field, and bend over backwards to ensure they are supported for their fight. You must be able to operate like this, at all times and in all conditions, and get it right every time. Incident Command is a key command system that makes this work. So when I view how this command post operations center operated in this battle, I have to shake my head in disbelief.

Another thing with dispatching is that highly experienced forest fire fighters were very nice to have in these centers, just because they could interpret the events happening out in the field, and help devise better plans of support. That they could share the reality of the folks out in the field, far better than a dispatcher that has never been out in the field. That’s not to say that dispatchers without fire fighting experience are not good–it’s just they do not have the same ‘orientation’ as experienced fire fighters. (OODA totally applies to this battle, and fire fighting/dispatching)

Although, both types of dispatchers helped tremendously. Two different types of orientation, all contributing to a fast paced decision making environment… I think military folks could learn a few things from these centers.

Also, the company that produced this video put together some fantastic training videos on squad movements and other infantry related skills. Either way, check it out and let me know what you think? –Matt

Funny Stuff: Chinese Army Hand Grenade Fail!

Probably the funniest and coolest part about this video is the instructor. He saves the soldier by pulling him into the trench, and then the soldier leaves after the explosion and the instructor goes right back to the ready line and squares it away. lol Now that is a dedicated instructor. –Matt
