Job Tips: UAE Travel And Shipping Stuff

     What sucks is; just a few months ago I brought most of my gear through Dubai; and I could have been arested. This was because the US Military P.O. would not let me ship most of my gear from APO in Iraq to APO in Afghanistan. It’s BS man,  and it is going to come down to-we have to risk getting arrested just to get our gear to our work place.-FJ Reader

    I wanted to get this out there for folks to think about and discuss.  Many contractors pass through the UAE for work, and this country keeps changing their laws and rules without getting the word out to the companies or contractors. All I have to say is that they are doing a poor job of strategic communications, and an excellent job of arresting contractors. (perhaps that is the goal? lol)

    If you look at the DoS travel advisory for the UAE, their treatment of the subject is pretty thin.  Do they not understand that thousands of contractors pass through these airports every year, and most of them are doing the good work of protecting folks and things in the war zones? They are putting their lives on the line for the US and it’s allies in the war, and they continue to be treated as a second class citizens.  At the very least, DoS could be a little more responsive to this issue, and maybe even push back. American citizens are getting arrested because they are not getting the word, or they have poor interpretations of the laws, or they are not aware of any new laws the come up out of the UAE, and the US embassy should be out there doing what they can to prevent this type of thing.

    I also put some blame on the companies for not taking care of their people.  You need to be pressing the embassy and the UAE for exactly what is required, and not just ‘ho hum’ your way through the whole thing. Contractors should be considered your most valuable asset, and by not doing everything you can to educate them with the most up to date laws of other countries, just shows a lack of compassion or responsibility on the company’s part.

    Then of course there is personal responsibility.  Guys have to get educated on this stuff, and that is why I constantly tell folks to do your homework about this industry.  Go to the forums and relevant websites out there, read what everyone is talking about, ask your questions if you haven’t found it in a search, and get educated. It is also important to really listen to your company or what the older guys have to say in this industry, because sometimes they do get it right and they do know what is best for travel on that particular contract. Don’t assume anything and get the facts.

    The quote up top was from a reader that was in a sticky situation, and this is a good example of the kind of dilemmas you can get into. In their case, they were traveling from one war zone to the next and their equipment was essential for the job.  They did not have a civilian parcel company at the base to use, and the only means of getting the stuff to their work site was carrying it through checked baggage or sending it APO to APO via military post office. My question here is why is the US military not working with contractors by allowing them to ship APO to APO? And because this contractor had no idea about the new laws or updates to the laws in the UAE, he could have been arrested just like the other guys.

    The other point about this situation was that sometimes at these airports, no one cares and it seems these policies and laws are only enforced by the officers that wish to do their job that day.  Or an officer does their own interpretation of the vague rules, and once they commit to the arrest, of course they are not going to backtrack and admit they were wrong. (unless a higher up that has been pressured diplomatically intervenes-hint, hint to the embassy) Some officers demand a bribe or maybe they have some bias–who knows. But this is the way travel is in some foreign countries and their airports.

     Now looking at all of these scenarios, you would think that companies would provide all the equipment necessary to do the job out there.  The truth is, that they don’t. Most contractors, to include myself, have had the unfortunate experience of being without some essential equipment in war zones, and all because a company made false promises about equipment, or the stuff they had was limited or in poor condition.  As more airports and countries introduce more strict rules on contractor related equipment, and as the enemy continues to conduct system disruption attacks that spawn more idiotic rules in airports, it will be increasingly important for contractors to be aware and/or increasingly depend up the company to provide this stuff. But that would require a company to actually care or cut into their profits to properly outfit their contractors.

    Which brings up another point.  Many companies use contractors because of the tax benefits and the ease of hiring or getting rid of them.  They also like security contractors because we usually have our own ‘tools’, much like a contractor in the building industry. Contractors even write off that equipment on their taxes.  So as more of these airports clamp down on contractors and limit their ability to transport their kit or ‘tools’ to a work site, then companies will be forced to incur more cost and provide those tools for the contractor. That kind of sounds like ’employee’ country, and not contractor stuff now and companies need to be aware of this stuff. (some companies rent the gear to the independent contractor, as an example)

    Now for another issue with shipping. What is with this dumb rule that came out where guys could not send their ACOG scopes home through military PO’s, because of the ‘gas’ that is in the ACOG? I have heard this from several contractors that tried to ship home their ACOG’s and the military told them they couldn’t do it. Luckily, from what I heard on the forums, folks are able to ship home their ACOG’s through a civilian parcel.

    I remember going through the same hassle with body armor or knives, and in my view, a military PO should do all they can to accommodate and work with contractors so that they can get this done.  In my case, I just sent the stuff home through civilian parcel because I was not allowed to send this stuff. But it was also more expensive and I was lucky that I was on a base that had a civilian parcel office. On some of my other contracts, I just had to give my stuff away to someone else that could use it, and eat the loss. This is repeated many times by contractors in the war zones and I guess you could call this the cost of doing business. –Matt

UAE authorities will confiscate any weapons, weapon parts, ammunition, body armor, handcuffs, and/or other military/police equipment transported to or through a civilian airport. U.S. citizens have been arrested and jailed for transporting such weapons and equipment without the express written authorization of the UAE government, even though airline and U.S. authorities allowed shipment on a U.S.-originating flight. – DoS Travel Advisory here.

Recent Changes In UAE Law For Travelers And Contractors

 … all US personnel – to avoid violation of Emirati laws by the intentional or accidental transport of any arms or items considered as law enforcement equipment or military gear. UAE airport personnel will x-ray all baggage – checked or carry-on – and cargo shipments, including household goods, both incoming and outgoing.  UAE authorities will confiscate any weapons, weapon parts, ammunition, body armour, handcuffs, sensitive electronics, cryptographic devices, and/or other military/police equipment transported to or through a civilian airport. Persons found to be carrying such items will be arrested and face strict criminal penalties, including imprisonment and large monetary fines…  One such incident involved one bullet, found in the bag of a traveler who had unknowingly left the item in his bag.  This individual was detained by the police and now faces a possible jail sentence and large monetary fine.  In other similar incidents, U.S. defense contractors transiting the U.A.E. with weapons were arrested and are now serving jail sentences of several months.The following is a sampling of the types of items that are illegal in the United Arab Emirates.

The list is NOT all inclusive, but does include the following:

• Weapons of any type, to include guns of any type, including simulators, assembled or disassembled, in carry-on or checked baggage.

• Ammunition or pyrotechnics of any type to include spent brass or casings.

• Body armor, including ballistic vests and military/police helmets.

• Police or law enforcement paraphernalia, including; handcuffs, flexi-cuffs, night vision goggles, gun holsters, pepper spray etc.

• Military-style electronics and cryptographic devices.The smallest quantity of any of the above mentioned items can result in detention and prosecution, to include a possible jail sentence, in the United Arab Emirates.

Industry Talk: Private Security Companies Sign Landmark Code Of Conduct In Switzerland

     This is great news and a big round of applause to all involved for all the hard work they put into this over the years. I think it is very significant that so many of the big name companies have signed on to this thing from around the world, and that there has been such wide support from outside organizations.

     Below I posted the DoS statements on the signing, as well as press releases from Triple Canopy and AEGIS. Now what will really be interesting is how this will be implemented, and how it will help to get companies to do the right thing.

     And like what the article below has stated, this Code of Conduct does not mean that the customer does not have to do anything anymore in terms of regulation or oversight. This just gives them a tool to work off of. So hopefully the efforts of the US government will continue down that path of creating a strong and effective contracting corps.

     Especially as the DoS enters into the new phase of these wars, and they become more dependent on the services of security contractors to continue the mission. Or as the shipping companies continues to look more towards armed private security for their boats.  –Matt

ISOA Applauds the Signing of a Landmark Code of Conduct

Trade Association Endorses a Voluntary Code to Address Responsible Oversight and Accountability of Private Security Companies

Washington, DC – The International Stability Operations Association (“ISOA”), a trade association that promotes high operational and ethical standards among its membership including more than twenty private security firms, today strongly endorsed the first-ever International Code of Conduct to ensure better transparency and accountability within the stability operations industry. The code was signed earlier today in Geneva, Switzerland, by more than fifty private security companies, including many ISOA Member companies. Among the speakers at the event were Swiss State Secretary Peter Maurer, Triple Canopy CEO Ingacio Balderas, G4S Director of Public Affairs Michael Clarke, Legal Advisor to the U.S. Department of State Harold Honju Koh, and Devon Chaffee of Human Rights First.In particular, this voluntary Code of Conduct highlights private security contractors’ commitment to respecting human rights and the rule of law in conflict zones, such as Iraq and Afghanistan. For example, it offers guidelines for the rules for the use of force and requires standards for recruitment, vetting, training, management of weapons, and internal control mechanisms. It also requires companies to ensure their employees “take all necessary steps to avoid the use of force” and explicitly bans mistreatment of detainees, forced labor, and sexual exploitation. Industry Talk: The Rise Of The UK’s Private Security Companies

     Good little story on the UK private security industry. Also it is good to see Andy Bearpark of BAPSC and Mr. Binns of Aegis get a little attention in the report.

     One area that I would like to further clarify though is that British companies are not immune from making mistakes or being involved in ‘gung ho’ operations, as the article below has stated. They typically do a good job, but believe me, back in the early days of Iraq, the British companies did stupid things out on the roads and on the bases as well. None of the companies were immune from making mistakes out there. But what defined the good companies from the bad ones, were those that cared to get it right and learned from those mistakes.

    Also, there was no mention of the upcoming International Code of Conduct signing taking place on Nov. 9th in Switzerland? Partners in the UK and the US have been involved in the creation of this code, and this will be a document that will help to further classify ‘industry best practices and standards’ that could be instrumental in weeding out the bad companies, both in the UK and the US. –Matt

Major General Graham Binns is not your typical chief executive.

As a lifelong soldier, he is more used to commanding an armoured division than a company boardroom.

In 2003 he commanded British troops invading southern Iraq, and in 2007 returned as the commander of British forces overseeing the handover of Basra to the Iraqis.

But now, four months into his new job as chief executive of Aegis Defence Services – a British private security company (PSC) – he has left army life behind.

“It’s liberating,” he says, sitting in Aegis’s comfortable headquarters in a plush office building in central London.

“Thirty-five years in government service was a wonderful experience. But in the world of business, ex-military people have got a lot to offer – I certainly hope so anyway.”

For Aegis, netting a leading figure from the Iraq war can only be good for business – particularly when your business is in the often-controversial world of armed private security.

Now one of the UK’s biggest PSCs, Aegis has made millions from the conflicts in Iraq and Afghanistan since it was founded just eight years ago.

It is even fair to say that Aegis, like much of the private security industry, owes its very existence to the last Iraq war.

“Certain activities can be done much more cost-effectively by the private sector” said Andy Bearpark of BAPSC

When the occupying forces found themselves trying to reconstruct the country while overwhelmed by Iraqi insurgency and sectarian violence, PSCs saw a lucrative opportunity.

“In Iraq in 2003 and 2004 money was basically free,” explains Andy Bearpark, director-general of the British Association of Private Security Companies (BAPSC).

“That meant [private security] contracts were being let for ridiculous amounts of money – millions and millions of dollars of contracts being pumped into the industry.

“The industry exploded in terms of the volume of business on the back of Iraq.”

Dozens of firms from the US and the UK stepped in to offer their services, providing governments and reconstruction NGOs with armed security personnel, convoy escorts, logistics support, training for the Iraqi security services, and risk analysis.

Names like Armorgroup and Control Risks, which had been around in the UK since the 80s, saw a chance to expand their businesses.

Logistics: US And NATO Making Deals With Russia, A New Rail Line, And Getting Closer To Dropping Pakistan Routes

     At the moment, about half those supplies come through Pakistan. The Pakistanis only closed, for about a day, one of the two main routes. About 30 percent of the supplies come in via Central Asia railroads, and another comes from the Black Sea, via rail to the Afghan border. The remaining 20 percent comes in by air. But some of that may be shifted to the Central Asian route, which is much safer (from bandits, bad roads and the Taliban) than the Pakistan routes.

     The U.S. and NATO supplies coming in via railroad from Western Europe, go through Ukraine, Belarus, Russia, Kazakhstan and Uzbekistan, to Afghanistan. This approach costs $400 a ton to get supplies into Afghanistan, versus three times that to truck it in from Pakistani ports, or $14,000 a ton to fly stuff in. This Central Asian route has been under negotiation since 2003, but Russia kept agreeing to it, and then withdrawing cooperation. What has finally compelled Russia to cooperate in the last year is the growing problems they are having with heroin and opium coming out of Afghanistan into, and through, Russia.-From Strategy Page

    Boy, this latest deal with Pakistan shutting down the border after the cross border accident is any indicator as to how unstable the logistics route is, then news like this should be good for the US and NATO. Although any deals they make with Russia will have to piss off Georgia, whom has contributed forces to the war effort. It is also risky to now make Russia a partner with all of this, because they could play games with the rail system. I guess they would be the best route to go with out of the two bad options available.

    The other point is that Russia is very smart when it comes to leverage and negotiations. The more we have issues on the Pakistan border with crucial logistics, the more the coalition is up against the wall to use a different route–and they don’t have many options. Especially when cost is increasingly becoming an issue. So at this point, Russia is going to negotiate all types of sweet deals in regards to NATO and how it impacts Russia. I just hope that whatever deals we strike up, that the US and NATO don’t get screwed in the long run. Russia knows it has the cards.

    On the flip side, I just posted a deal on Russia thinking about using private security firms for their companies overseas. I could see them utilizing these types of paramilitary forces for work in Afghanistan, if in fact the US and NATO could convince them to participate. Russian troops in Afghanistan would be too much to ask I think. You never know though and I never cease to be amazed with this stuff.

     I also mention private industry as a better option because of all of the Mi-17s that Afghanistan is buying up. Russia would be a good choice for instructors and maintenance types in these contracts to ensure that Afghanistan gets a good value. Plus, the Russians wrote the book on using the Mi-17 in Afghanistan during their war there and these Mi-17s are familiar to the Afghans. Most of all, there is the maintenance of these aircraft post war.  Poor countries with little in the means of parts or repair capability, will really appreciate the durability, cost and simplicity of this aircraft when everyone is gone and packed up.

     Afghanistan will also appreciate all of these railroads coming into their country, because that will make it significantly cheaper for investors to do business there.  The US and NATO will enjoy a cost savings as well, just as long as Russia is happy, and the Taliban can be put in check in the north. From the northern Afghan city of Mazar-e Sharif to the Uzbek border, the land runs flat with barely a hillock to block the way.

It is perfect terrain for building a railway. So, since Afghanistan inaugurated construction of its northern rail line in May, progress has been fast.

Now, the Uzbek company contracted to lay the track has completed almost all of the 75-kilometer line. According to the schedule, the construction should be finished by the end of this year.

If so, Afghanistan will get its first railroad in more than 100 years. That is when a former monarch, Amir Abdurrahman, banned rail lines as potential invasion routes.

Officials say the railroad will speed up freight deliveries across the Uzbek border dramatically.

Industry Talk: Afghan Ban On Security Firms Delayed By 2 Months

     That’s a start. Although I wonder how much we had to pay Crazy Karzai for this two month extension? lol Lately I have been reading all the latest articles about this circus, and it is just dumb. It is obvious that Karzai is playing games. I mean this guy is talking with the Taliban, getting money from Iran, and at the same time jerking us around about PSCs in Afghanistan.  He is using the ban on PSCs as a means of extortion and it is just dumb. It’s almost as if some agent was able to penetrate his brain and plant this idea, ‘Inception‘ style.

     Because lets be real on this one. Karzai’s life was dependent upon private security during many of the years of his presidency. His family operated private security companies who made millions of dollars from contracts over the years. And all of these recent incidents involving kidnapping, attacks on facilities, and attacks on convoys all highlight how important security is. If there are not enough troops to do the job, then of course private security is the next step, and yet Karzai wants to ban them?

     Also, if Karzai has an issue with companies, then instead of throwing the baby out with bath water, he could instead ‘fairly’ issue licenses (which they do, yet does not regulate or manage well ) and require them to be bonded. A bond could make it extremely expensive for companies that screw up, and give the offices an incentive to watch the industry. That would be one way for him to control and regulate companies.

     The alternative is that he kicks out all of these companies, to include expat companies, and all of the programs they were tasked with securing will falter. Billions of dollars in aid designed to rebuild and infuse money into the local economies, will now be shut off because these programs do not have security. Not to mention investors will now have second thoughts about doing anything in Afghanistan, all because they are not allowed to use private security.

     The logical way to reduce the numbers of contractors is through success in the war. As security increases, attacks and threats decrease, and the requirement for security will decrease. Actually this would be a great metric on how the war is going, and if security contractor use naturally decreases because of that classic market force called ‘a lack of demand’, then this would be an excellent indicator that things are getting better.

     It is a lot like the timeline issue that I have talked about in the past. The enemy loves timelines, because it is a date for victory. Troops or contractors should leave not based on timelines but based on progress and success. –Matt

 Arg, Kabul – For a rapid implementation of Presidential Decree 62 on the dissolution of private security companies, President Hamid Karzai has ordered the establishment of a committee led by the Minister of Interior and participated by representatives from NATO-ISAF and major international donors.

The Committee will develop plans for the disbandment of the PCSs that provide security for development projects and report on progress to the President.

The phasing out of illegal PCSs and road convoy security companies continues on a priority basis as laid out in the Decree.

Recognizing the importance of maintaining the continuous delivery of critical development projects and programs funded by the international community, the Committee will prepare a timetable for the disbandment of the PCSs that secure development projects and submit it to the President on November 15th, 2010.
